The Terms and Conditions listed below in this document apply to the website Talabna.ae.ae and Talabna.ae Apps, owned and managed by Talabna.ae, and all its divisions, subsidiaries and affiliated sites. This is a legal document wherein Talabna.ae will hereafter be referred to as 'We', 'Us', 'Our' or 'Website' and the Users and Customers will be referred to as 'You', 'Your', 'Customers' and 'Users'.

The use of this website/app implies that You, our Customers/Users have read and understood the Terms and Conditions governing this website/app and agree to the same. All our users and customers are expected to read through our Terms and Policies carefully before continuing use of Talabna.ae.ae. If you do not agree to any of the following Terms and Conditions listed herein, you may stop using the website/app.

General Terms of Use

Talabna.ae is a food delivery aggregator platform that grants access to users to buy food and beverage related products from third- party vendors and businesses. We reserve the right to introduce new products and services and update or withdraw any of the products , menus and services currently being offered, in our sole discretion, and we will not be liable to you for exercising this discretion.

You are eligible to register with Talabna.ae as a buyer, if:

• You are above the legal age for purchasing products in your country of residence
• You are able to provide an address in the UAE for delivery of products.

You are eligible to register with Talabna.ae as a Seller, if:

• You are a legal entity registered in your jurisdiction.
• You hold a valid trade license.
• You hold proof of authorization for acting on behalf of your business/company
• You are able to provide sufficient bank details to support all monetary transactions
• You agree to meet additional support required to sell/list certain products whenever required
• You shall fully comply and conduct yourself within the website/app in accordance with all the applicable laws, statutes and regulations, including, without limitation, all privacy laws and content regulation

If you create or use an account on behalf of a business entity, you represent that you are authorized to act on behalf of such business and bind the business to these Terms and Conditions.

Any content you submit as part of your use of the Services and any products that you list do not violate the rights of any third party anywhere in the world including, without limitation, any Intellectual Property Rights (whether registered or not).

you acknowledge and agree to the fact that Talabna.ae.ae reserves the right to accept or decline your registration request if your supporting documents are found to inadequate or if found not validating your identity.

Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself and to promptly update such information if there are any changes. On registering successfully, your registration will continue to hold good for a two years period unless we decide to suspend or terminate your registration due to unlawful or improper use or conduct within the platform. The membership account owners are entirely responsible for all activities that occur under the account. The Content provided on the website/app (including but not limited to the images, texts, fonts, design patterns and colors) has been developed in order to provide the users/customers with as detailed and factual information about our products and services as possible. Product representations expressed on this website/app are those of the vendor and are not made by us. Product Reviews, Ratings and comments that are displayed on the website/app are that from our Users/Customers and does not reflect our opinions. Any information you share in the website/app, including but not limited to questions, reviews, comments and suggestions will become our exclusive property. Talabna.ae.ae shall have the right to remove or edit any user content if found to be originating from false email addresses or phone numbers or names.

Terms of Sale

Talabna.ae.ae has strict policies against customers/users found to be using the website/app for ordering products in bulk for resale purposes. We reserve the right to refuse or cancel any order placed by you if the product or service ordered is;

• Out of stock
• Damaged or incomplete
• Out of delivery location

In the event that the product has been mispriced on the website/app, our team will reach out to you to notify the change in price and will accordingly decide to either cancel or fulfil the order.

Liabilities, Indemnity and User Responsibilities

As customers/users of Talabna.ae.ae, you will be responsible for

• Maintaining the confidentiality of and restricting access to and use of your account and password, and accept responsibility for all activities that occur under your account and password.
• Providing only true, accurate, current and complete information about yourself when requesting a product or service
• Providing additional information about yourself if required by us in order to verify your eligibility and usage rights
• Ensuring that all posts, lists and upload content from your end is appropriate and lawful and does not come across as religiously or culturally offensive in any way
• Ensuring that information uploaded by you is in compliance with the general local laws, Islamic laws, rules, morals, values, ethics and traditions of the region/country and is not a threat to the national security
• Make sure that you do not post fake/stolen or counterfeit items
• Not breaching or circumventing any laws, third party rights or our policies on terms of conduct and usage
• Refraining from manipulating the price of any item either intentionally or otherwise
• Not interfering with the listings/posts/reviews/comments of other users/customers
• Getting a prior written consent before transferring the rights of usage of your account to any other third party
• Ensuring that you do not distribute viruses or any other technologies, either intentionally or otherwise, that may harm the website/app or app functions and interfere in our ability to provide and fulfil orders and services
• Paying for items purchased by you, unless there is a valid reason as stipulated under our terms and policies
• Delivering items sold by you, unless there is a valid reason as stipulated under our terms and policies
• Using the contact information provided during the transaction solely for activities within the Talabna.ae website and/or App and not in any other third party platforms or website/app.

The clauses mentioned in the Terms and Policy documents do not limit or exclude the user/customer’s liability for

• Fraud/fraudulent misrepresentation
• Death /personal injury caused by the negligence of the user/customer

The owners/proprietors/agents/partners/employees/suppliers/subcontractors or third party contract workers of Talabna.ae will under no circumstance be held liable in any event of dispute/claim from the customers/users, be that over

• Information provided by you when using/accessing the website/app
• Your inability or incomplete knowledge of how to use/access the products and services offered on our website/app
• Pricing, Delivery, format or other guidance provided by us
• Unexpected delays or disruptions in our services or deliveries due to natural calamities, market instability or other unforeseen situations that are beyond our control
• Viruses, bugs or other malicious software obtained by accessing or linking to our services
• Errors or inaccuracies in our online products or services
• Damages caused to your hardware device from the use of products sold in our website/app
• The content, actions of third parties or other users who have access to the website/app
• The duration or manner in which your products and services appear in our search results (applicable for vendors)

In case of disputes where your claim for compensation is found valid and legally applicable, our total liability, arising out of the situation will be limited to

• The price of the product or service sold on our website/app including its original Delivery fees.
• The total amount paid to us in the previous 12 months leading up to the event causing the liability claim

Users/customers shall agree to indemnify and hold the owners/proprietors/agents/partners/employees/suppliers/subcontractors or third-party contract workers of Talabna.ae harmless from and against any losses, damages and expenses (including the legal/arbitration fees), arising out of/relating to;

• claims or demands made by a third party due to your use of our services
• your violation of the provisions in the Terms and Policies documents, representations and undertakings
• your violation of the governing laws on the country or any other applicable laws including data protection and anti-spam laws

Copyrights, Trademark and Intellectual Property Rights

All content included on our website/app, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property and copyright work of Talabna.ae, its users, its content suppliers or its licensors and is protected by copyright, trademarks, patents or other intellectual property rights and laws.
‘Talabna.ae’ and its related logos, images, taglines, captions, font and colour combinations, design elements are either unregistered or registered trademarks of Talabna.ae, and are protected by international trademark and other intellectual property rights and laws.
These trademarked or copyrighted content/designs/logos cannot be used in any other platforms in connection with any other products or services that are not owned or managed by Talabna.ae.
All rights, title and interest in and to any information, materials or other content that is provided by you in connection with your use or access of the website/app, including all Intellectual Property rights therein, will be become the property of Talabna.ae.
No user/customer shall have any right to use our trademarks without prior written consent from us.
